If I Pay for a Custom Mold, Who Owns the Custom Bag Mold Ownership — Intellectual Property and the Physical Tooling?

In most cases, once you fully pay for custom tooling, custom bag mold ownership transfers to you — meaning both the design intellectual property and the physical mold become your exclusive property. This arrangement is formally documented in our custom manufacturing agreement, which outlines tooling payment and ownership terms, so there’s no ambiguity about who holds rights before production begins.

Physically, the mold remains stored at our facility for ongoing production convenience, but it is registered and locked to your account through our project management system, preventing it from being used for any other client’s orders without your written authorization.

Regarding intellectual property, your ownership rights are further reinforced through the signed NDA and IP assignment clause included in your project onboarding, which legally confirms that design elements developed specifically for your mold cannot be replicated or resold.

These practices align with internationally recognized industrial design protections outlined by the U.S. Patent and Trademark Office (USPTO) design patent guidelines, giving you added legal clarity on how tooling-related IP rights are typically structured and protected.

If you later decide to switch manufacturers, you may also request physical mold transfer or destruction, subject to the terms specified in your signed agreement.
